So im searching through ebay today well i ponder about a nano set up for the kitchen....and i come across a product for par38 bulbs. I click it and the main pic they have is of my tank! LMAO

Those arent even thier bulbs above it! LOL
Guess u know u made it when the people selling the crap use ur tank for advertisment!!!!

I agree it is funny and I also thought the sue route would be good.

But honestly you should contact them because that is false advertising. They are saying the lighting in that picture is from their bulbs when clearly it is not. There needs to be some kind of accountability for these people when they are falsely showing what they 'say' their bulbs are capable of producing. What happened to honesty and integrity? UGH!

While the photo is copyrighted, by the photographer, the moment the shutter is pressed AND you can force them to remove the photo from their advertising, unless you've actually Registered the photo, with the US Copyright Office, you can't go after them for any monetary damages. IF you've actually registered the photo, you can go after them for damages.

Registered or not, I would definitely report them to Ebay for using your photo AND I would send them a cease and desist letter, demanding that your photo be removed from their advertising.

Huh??? LOL!! Not sure if we are understanding each other. Maybe I'm lost :lol:. The picture they have for their advertisement is a picture of your tank right? If so, how did they get the picture of your tank? I'm figuring if you only posted the picture of your tank here on RF, then they must have gotten the picture by browsing RF. That's all I'm saying...Nothing more.

Lol no its still set up...a lil diff now but better imo... @Krish...no prob off photo bucket or other forums I used to visit more frequent....I'm at home sick today and been sick so makes things difficult.

Have you contacted this Ebay seller, demanding that your photo be removed? Also, contact Ebay, giving them a link to your photo on your photobucket account.
